OK, My mistake - Dredd was a 15 in the UK, IIRC, rather than an 18 and I assumed that this would translate into a similarly lower rating in the US. Certainly the level of violence in the Stallone...

Also Dredd's failure (in the US, not elsewhere) was more due to marketing - or lack thereof - than the rating. Same as John Carter.

My understanding (not sure where I picked this up from) is that, as long as there is no reference to X-Men, Magneto, etc, as they are also Avengers characters, they can be used by Marvel/Disney.
